RESIDENCES: Milan, NY

LAND: Enoch Conger, son of Benjamin Conger Sr. lived at Milan, NY. He is mentioned in several deeds, one of which dated 31 May 1837, shows that Enoch Conger and wife, Lydia, of Milan, deeded to William Brewer and Burnett M. Carroll fo $1228. Perhaps at this time he was selling out, and leaving, as there is no further record.

2041. Benjamin W. Every


Benjamin W. Every

BIRTH: If the age of maturity was 21 years, as of 1838, he would have been
born, Abt. 8 Apr 1817.

LEGAL_MATTER-PROBATE:
In 1838, Benjamin W. Every sued the executors of his grandfather's will for his
legacy (10 sheep given him by his grandfather, Benjamin Conger).

Among the items gleaned from the complaint are that Benjamin Conger Sr. died
about 1822, and that Benjamin Every became of age 8 Apr 1837.

Richard Connelly, farmer (son-in-law of Benjamin Conger, aged 65) having
married his daughter, and had always lived near his farm, testified that Every
was brought up by Benjamin E. Wildey and wife, they had no children of their
own.

Zillah Wildey of Milan, Dutchess county, New York, testified that she had
brought up Every, her sister's son, and that he lived with her ever since; also
that her husband died in February 1831.

In a letter from one L.S. Wildey on 29 Sep, he states, "I know very little
about the Conger family, except that Zillah Conger married Benjamin Wildey, and
that they had no children."

Clinton Conger of Milan testified, that he was a farmer, aged 24 years, and
that he was the son of Enoch Conger, one of the executors. His testimony also
mentions his brother, Asher Conger.

An H.B. Sherwood, writing from Standfordvill, Dutchess, New York on 10 Oct
1907, said that a Clinton Conger lived at Milan for some time, and believed he
died on a farm near the Pine Plains line, unmarried.

PROBATE: The will of Benjamin Conger provided that his widow, Gertrude Lemmerman Conger have the income of $3,000 and at her death the priciple was to go to his four grandchildren: Jefferson Davis, Emma Davis, Susan Palmer and Ida Shultz. To the wife of his son, Moses, he left the income of $1,000. The residue of the estate was given to his daughters, Louisa Shultz and Caroline Davis. The executor of the will was his son, William H. Conger.
