Federal District Judge, Edward A. Conger, 81, friend of President Franklin D. Roosevelt and an early supporter of the New Deal, died last night at St. Francis Hospital from the effects of a stroke suffered Sunday while visiting Miss Minnie Conger, his sister. Only a day before, he had attended a family reunion at the home of his son, Edward J. Conger, in Kingston, NY.As a native of Poughkeepsie, he was educated in schools there, receiving a law degree in 1904 from New York Law School. He practiced law with the late Frank B. Lown until 1908, when he was appointed an Assistant District Attorney under John E. Mack as Dutchess County District Attorney in 1913 and served until 1918, when he was named a City Judge to complete an unfinished term. Afterward, he practiced law with Mr. Mack.
In 1938, President Roosevelt, a Dutchess County neighbor, appointed Mr. Conger to the Federal bench of Manhattan's Southern District, which embraces the counties of the Bronx, New York, Columbia, Dutchess, Greene, Orange, Putnam, Rockland, Sullivan, Ulster and Westchester. He was president of the Dutchess County Bar Association at the time.
On the bench, Judge Conger presided over many important cases, including one involving a contempt citation against Frank Costello, the underworld figure, Communist subversives, and many anti-trust proceedings. In one of his most publicised cases, Judge Conger ruled against three baseball players who had been suspended for five years by Baseball Commissioner A.B. (Happy) Chandler for jumping to the Mexican League. The three -- Danny Gardella, Giant outfield, and Max Lanier and Fred Martin, pitchers for the Cardinals -- lost an appeal too. Among the important trials at which Judge Conger presided was the bankruptcy case involving the New York, Ontario & Western Railroad, which dragged on for years.
In 1954, he wrote to President Eisenhower, asking for permission to retire, since he was 72 -- two years beyond the normal retirement age. In reply, the President expressed his appreciation of Judge Conger's 'splendid service.'
Judge Conger began to take an interest in politics early in his legal career, and rose to become a power in Dutchess County Democratic circles. In 1937, he ran unsuccessfully for Surrogate.
He also was active in community affairs, having been a member of the board of trustees of St. Francis Hospital and the Barnard Library, a director of the Community Chest, president of the Cardinal Lay Committee for Boy Scouts, a member of the nominations committee of the New York State Bar Association, the Charter Committee of the Ninth Judical District, the Knights of Columbus, the Elks and the Dutchess Golf and Country Club.
Surviving besides his son and sister, are two daughters, Mrs. Catherine Hayes and Mrs. Anne Elizabeth McCluskey, and 20 grandchildren.

DEATH: Charles Henry Conger was a telegraph operator in 1893. The R.R. Repair Shop (cutting shop) sent him to New London, Conn., to work on passenger trains. When on the way to work he used the R.R. tracks in walking. There was another train on the trestle above him, so he didn't hear the one behind him. His hand was severed; a blood clot formed. He died before they could operate. (The beam on the engine hit him on the head, and he fell with his hand on the rail.)

BIOGRAPHY:
From a St. Albans, [VT] newspaper clipping, "Reflections of Yesteryear," by Adelaide Chandler (1918). "Earl S. Conger of this city, a member of the Machine Gun Company, is another from this city to be cited for bravery in action."Earl was a farm worker and truck driver for several years in Conn. He went to work at Bermuda on a government job for a contractor as a mechanic on the first project, requiring heavy equipment. On completion he returned to the States and shortly thereafter was called back as Suvervisor to keep the heavy equipment in repair. His half-brother, Ralph, [Ralph Albert Conger] worked for him until his retirement in June 1970.
